Terms of engagement

Last updated: 27 October 2026

1. Scope of application

These terms apply to all engagements of Henry Privacy, Gabriel Henry. Deviating agreements apply when recorded in writing; email is sufficient.

2. Services and scope

Henry Privacy provides advisory and documentation services on data protection and video surveillance as set out in the quote. The published “from” prices apply to businesses with up to 20 employees and systems with up to 8 cameras at one site. Additional work is charged only by prior agreement. Prices are in Swiss francs; any applicable VAT is stated in the quote.

3. Nature of the services

Henry Privacy advises and documents from a technical and organisational perspective. Technical expert reports are private expert reports. The services complement legal advice and do not replace it; for litigation and legal opinions, Henry Privacy works with the client’s lawyer on request.

4. Client cooperation

The client provides the required documents, on-site access and a contact person. Where cooperation is missing, deadlines shift accordingly.

5. Travel and appointments

Travel within the cantons of Aargau, Lucerne, Solothurn, Zug and Zurich is included. Elsewhere in Switzerland, a travel flat rate of CHF 150 applies per on-site appointment. Appointments can be rescheduled free of charge up to two working days in advance; for later changes, 50 % of the on-site portion is charged.

6. Payment

Invoices are payable within 30 days. For the data protection essentials, 50 % is due on order and the balance on delivery.

7. Confidentiality and data protection

All information from the engagement is treated as confidential. Documents are stored in Switzerland and deleted once the engagement is complete, unless the client wishes otherwise or a statutory retention obligation applies. References are named solely with the client’s consent. The privacy policy applies in all other respects.

8. Rights of use

The client may use and adapt reports, documents and templates for their own business without time limit and pass them on to lawyers, authorities and insurers. Passing them on to third parties for independent use requires the consent of Henry Privacy.

9. Liability

Henry Privacy works carefully and in line with the current state of law and technology. Implementing the recommendations and operating the systems remain the client’s responsibility. Liability for slight negligence is limited to the value of the engagement; liability for consequential damage is excluded to the extent permitted by law. Statutory law applies in cases of intent and gross negligence.

10. Governing law and jurisdiction

Swiss law applies. The place of jurisdiction is Aarau, to the extent permitted by law.
